A Lei n\u00ba 17.202\/2019, aprovada pela C\u00e2mara Municipal de S\u00e3o Paulo, facilita a regulariza\u00e7\u00e3o de im\u00f3veis residenciais e comerciais, promovendo a desburocratiza\u00e7\u00e3o e incentivando o crescimento econ\u00f4mico da cidade. A legisla\u00e7\u00e3o permite a regulariza\u00e7\u00e3o de constru\u00e7\u00f5es feitas at\u00e9 31 de julho de 2014, dividindo os im\u00f3veis em tr\u00eas categorias de regulariza\u00e7\u00e3o: autom\u00e1tica, declarat\u00f3ria e comum.<\/p>

Aspectos Importantes da Lei
Regulariza\u00e7\u00e3o Autom\u00e1tica: Propriet\u00e1rios de im\u00f3veis residenciais de baixo e m\u00e9dio padr\u00e3o (categorias R, R1 e R2h), que eram isentos de IPTU em 2014, ter\u00e3o suas constru\u00e7\u00f5es automaticamente regularizadas. O certificado de regulariza\u00e7\u00e3o ser\u00e1 enviado pela prefeitura, sem necessidade de documentos ou taxas.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Regulariza\u00e7\u00e3o Declarat\u00f3ria: Para im\u00f3veis residenciais unifamiliares e multifamiliares de at\u00e9 1.500 m\u00b2, o propriet\u00e1rio deve preencher uma declara\u00e7\u00e3o online no site da prefeitura, acompanhada da assinatura de um engenheiro respons\u00e1vel. Est\u00e3o inclu\u00eddos im\u00f3veis residenciais, Habita\u00e7\u00e3o de Interesse Social (HIS), Habita\u00e7\u00e3o de Mercado Popular (HMP), e edifica\u00e7\u00f5es de uso misto.<\/p>

Regulariza\u00e7\u00e3o Comum: Edifica\u00e7\u00f5es com mais de 1.500 m\u00b2 requerem um processo mais detalhado, que inclui a apresenta\u00e7\u00e3o de documentos e a an\u00e1lise da prefeitura. O projeto deve seguir as normas de acessibilidade e seguran\u00e7a e estar de acordo com o C\u00f3digo de Obras.<\/p>

Prazos e Benef\u00edcios
A anistia oferecida por essa lei termina em dezembro de 2024, portanto, \u00e9 essencial que propriet\u00e1rios interessados em regularizar seus im\u00f3veis sigam os prazos. Para im\u00f3veis isentos de IPTU em 2014, o processo \u00e9 autom\u00e1tico, mas para outras edifica\u00e7\u00f5es, o prazo para protocolar a regulariza\u00e7\u00e3o \u00e9 de 90 dias a partir de 1\u00ba de janeiro de 2020, com possibilidade de prorroga\u00e7\u00e3o por at\u00e9 360 dias.<\/p>

Al\u00e9m disso, n\u00e3o ser\u00e3o cobrados ISS (Imposto Sobre Servi\u00e7os) e IPTU retroativos, mas haver\u00e1 cobran\u00e7a de taxa de outorga para \u00e1reas excedentes constru\u00eddas.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Im\u00f3veis constru\u00eddos irregularmente em \u00e1reas p\u00fablicas, de preserva\u00e7\u00e3o ambiental, ou em disputa judicial, n\u00e3o s\u00e3o contemplados pela lei. Al\u00e9m disso, im\u00f3veis comerciais em \u00e1reas residenciais sem a devida autoriza\u00e7\u00e3o tamb\u00e9m n\u00e3o poder\u00e3o ser regularizados.<\/p>
